5.3 Data Processing Units (DPUs)
- Each plan includes a monthly allocation of DPUs
- Unused DPUs do not roll over to the next billing period
- Overage charges apply at the rate specified in your plan
- You can monitor your DPU usage in your account dashboard

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify us against claims arising from:
- Your use of the Services
- Your content
- Your violation of these Terms
- Your violation of any third-party rights
14. Governing Law
These Terms are governed by Utah law, without regard to conflict of law principles.
15. Dispute Resolution

Arbitration will be conducted by JAMS under its Comprehensive Arbitration Rules in St. George, Utah.

These Terms constitute the entire agreement between you and Cerebro.
16.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
16.3 No Waiver
Our failure to enforce any right will not constitute a waiver.

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
16.5 Force Majeure
We are not liable for delays or failures caused by circumstances beyond our reasonable control.
